Resolution on Procedures for Handling Charges of Harassment Against Faculty Members

Be it resolved that:

  • The New Brunswick Faculty Council recommends that the University Administration and the AAUP negotiate a contract provision affording a faculty member accused of harassment an evidentiary hearing by a neutral body composed of peers of the complainant and the respondent before such faculty member may be suspended without pay.
  • In addition, the New Brunswick Faculty Council urges that the following clauses by considered:
    • That ordinarily, before resorting to suspension, all efforts should be made to separate the complainant from the respondent and to ensure that the respondent does not retaliate against the complainant.
    • That any source of counseling should be a subject of negotiation and periodic evaluation and that such counseling should be treated with confidentiality.
    • That if suspension without pay is rescinded, then the employee should be reimbursed with back pay and any expenses incurred as a result of lack of benefits with interest and that reimbursement of reasonable expenses of the exonerated employee will be governed by the same procedure as with cases of dismissal.
